Los Angeles white-collar criminal defense lawyer Mark Beck said some prosecutors today, particularly younger and greener ones, are less inclined to make informal, good-faith “handshake” agreements than in the past.

“You could stick your neck out because you expected something in return in good faith,” Beck said. “But there is this tendency now to make everything so formal and to remove the part of it that involves trust.”

While Beck was defending a client on fraud charges in federal court, he realized his team forgot to attach signature pages to juror questionnaires the morning before jury selection. The two senior prosecutors kindly offered to print them before the judge took the bench.

Beck later referred one of the prosecutors a case where a Los Angeles gallery was accused of selling one of his clients a phony Picasso. The prosecutor took the case, and Beck’s client ultimately got restitution.

“Courtesy doesn't mean weakness, and courtesy isn't for the purpose of not upsetting the judge or not upsetting the other side,” Beck said. “The goal is to upset the other side, turn them upside down, but how you go about it is the question.”

Named to Daily Journal’s List of Top White-Collar Criminal Lawyers in California

The Daily Journal, California’s largest legal newspaper named Mark Beck to its inaugural list of top white-collar criminal lawyers in the state. 

In profiling him, the Daily Journal, noted his extensive experience and his representation of two defendants in the massive “Varsity Blues” college admissions fraud and bribery cases. 

The profile also highlighted Mark’s role in changing a law enforcement policy so Los Angeles International Airport travelers with small amounts of marijuana will no longer be subject to prosecution. Mark’s client, who was charged while attempting to export medical marijuana legally acquired in California to his home on the East Coast, had been offered a plea deal until Mark persuaded prosecutors to drop the charges and change the policy. “Beck persisted, making the kind of presentation and engaging in negotiations with the prosecution just as he would have with a major felony,” the Daily Journal wrote.
